Under non-emergency regulations in California, businesses are required to keep records for 3 years. This includes details of the employee’s name, contact information, occupation, where the employee worked, date of the last day at your workplace, and the date of the positive COVID-19 test and/or COVID-19 diagnosis. Non-emergency COVID regulations came into effect in the State of California on February 3rd, 2023 and will remain in effect for the next two years. Businesses are required to rapidly implement new regulations into their workplace IIPP from this date and keep detailed records for regulatory purposes. On Feb 3 2023, OAL approved Cal/OSHA’s COVID-19 Prevention Non-Emergency Regulation. While some of the new regulations are similar to requirements currently found in the Cal/OSHA's COVID-19 Prevention Emergency Temporary Standards (ETS), the Non-Emergency Regulations do include some significant differences. These include the definition of a close contact, how employers should monitor and manage close contacts and record keeping requirements for close contacts.

In indoor spaces of 400,000 or fewer sq feet per floor (this includes clinic waiting rooms, labs, office spaces, etc.), close contact is defined as sharing the same indoor airspace for a cumulative total of 15 minutes or more over a 24-hour period during an infected person's infectious period.

In large indoor spaces greater than 400,000 sq feet per floor, close contact is defined as being within six feet of the infected person for a cumulative total of 15 minutes or more over a 24-hour period during the infected person's infectious period.

Spaces that are separated by floor-to-ceiling walls (e.g offices, suites, rooms, waiting areas, bathrooms, or break or eating areas that are separated by floor-to-ceiling walls) must be considered distinct indoor airspaces.
While the CDC guidelines for the workplace monitoring and management of COVID 19 are ever-changing, there have been a number of new rules and regulations brought into law for the State of California. These include compliance requirements for contact tracing for businesses up to 400,000 sq ft and businesses over 400,000 sq ft. Any business with one employee or more is required to have an Injury and Illness Prevention Program (IIPP) and from Feb 3 2023, must include new COVID-19 measures outlined by the State of California, Department of Industrial Relations. Without a proper IIPP you may be subject to fines by Cal/OSHA.
